Terms and Conditions
Your booking is accepted subject to the terms and conditions stated below. By confirming your booking, you are accepting that all these terms & conditions will apply.
Any amendments made to your booking after confirmation, can and will only be accepted subject to availability. Mini World Australia reserves the right to charge an amendment a fee in respect of any change to your booking, in addition to any other applicable charges in relation to the amendment.
In an event that you cancel your booking, Mini World Australia reserves the right to charge a cancellation fee for general bookings as follows:
• Bookings cancelled greater than 4 days prior to travel: up to 50% of the value of the booking
• Bookings cancelled between 1 to 4 days prior to travel: up to 75% of the value of the booking
• Bookings cancelled on the day of travel: up to 100% of the value of the booking
When booking a Wedding, Mini World Australia requests a 50% non-refundable deposit on the booking day and the remainder of payment will be required to be paid two weeks before the Wedding day.
In addition to any cancellation fee charged by Mini World Australia, you will also be responsible for payment of any charges levied by suppliers in respect of the cancelled booking. In all cases, the total fee charged will not exceed the value of the booking.
When booking a School Formal Mini World Australia requests a 100% non-refundable deposit on the booking day. All bookings for Formals are non-refundable and must be paid in advance unless agreed prior to event by Management of Mini World Australia.
You are responsible for any charges levied by suppliers in respect of extra time in the event that your booking does not run to schedule. This includes any extra charges levied where you choose to extend the duration of your booking including charges related to traffic delays.
The time of arrival at starting point, stop-over point, destination or return to point of origin cannot be guaranteed. Travel speed limits are prescribed by law, and Chauffeur is instructed to travel at all times at speeds compatible with safe operation as per legal speed limit permitted in NSW. Road, traffic and weather conditions are beyond the control of Mini World Australia, and the Chauffeur, and no refunds shall be given as a result of late arrivals due to such conditions or other occurrences out of the control of the Mini World Australia or the Chauffeur.
Mini World Australia reserves the right to refuse to transport persons under the influence of intoxication liquor or drugs, or who are, or are likely to become objectionable to other persons or if the Chauffeur feels threatened in any way.
Conduct While Traveling
Mini World Australia reserves the right to refuse to accept you as a customer or continue dealing with you if you or your group behavior is disruptive, or should any member of your group appear to be under the influence of prohibited (or licensed) substances causing a detrimental effect on you or any member of your party. Additionally Racially aggravated, Sexist and other derogatory comments and behavior will not be tolerated under ANY circumstances. If a driver deems any person(s) traveling in your group to be posing a danger, or act in an inappropriate manner to employees or indeed any vehicle belonging to Mini World Australia, we reserve the right to terminate the booking with immediate effect at the safest point to do so. No refund will be given in these circumstances and Mini World Australia cannot be held responsible for any associated costs incurred by you or your group. No correspondence will be entered in to by Mini World Australia should this situation arise. This additionally applies prior and post travel including threatening or abusive behaviour towards our staff or Management of Mini World Australia, on the telephone, in writing or in person. If you are disruptive and this means you are not allowed to board the vehicle outbound from your pickup, we will treat your booking as cancelled by you from that moment. If this occurs at your destination point then you will become responsible for your own return home and any other members of your group who cannot or will not travel without you. In any circumstance NO refunds or compensation will be paid to you or your party and additionally, Mini World Australia may make a claim against you for any costs and expenses incurred as a result of your behaviour e.g. the cost of diverting the vehicle for you or to your party.
If, during or after the transportation service, the Company is required to expend a greater than normal amount of time and material clean the vehicle due to acts of the Client, the Company, at its option, may charge Client additional fees to cover such additional time and materials.
Limitation of Liability
Mini World Australia shall not be liable in any event or for any reason, including breach of this Limousine Rental Agreement, either directly or indirectly, to the other party or any other third party for any special, indirect, incidental, punitive, exemplary or consequential damages or loss of profits arising out of this Limousine agreement, even if such damages were foreseeable or the company has been advised of the possibility of such damages. it is expressly agreed that Mini World Australia shall not, under any circumstances, be liable to any party for an amount greater than the single fare fee for the day in question.
Mini World Australia shall not be liable for any failure or delay in performing its obligations under the current Limousine Rental Agreement, and Mini World Australia shall not be deemed in breach of its obligations thereunder, if such failure or delay is due to Acts of God, natural disasters, national, state or local states of emergency, acts of war or terrorism, labor strike or lock-out, or any other industrial or any transportation accident caused by any third party, any violation of law, regulation or ordinance by any third party or any other cause not within the control of Mini World Australia.
This Agreement and its performance shall be governed by the laws of the State of NSW, in Australia without giving effect to applicable conflict of law provisions.
Arbitration - In the event a dispute shall arise between the parties to this agreement it hereby agreed that the dispute shall be referred to the Australian Arbitration Commission for three-person arbitration in accordance with its applicable Rules in NSW of Arbitration. The arbitrators’ decision shall be final and legally binding and judgment may be entered there on. Each party shall be responsible for its share of the arbitration fees. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrators’ award or fails to comply with the arbitrators’ award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.
Termination - If Client does not conform to the conditions stated in the Limousine Rental Agreement, the contract with Client will be terminated with immediate effect without warning or written notice, and the payment made will be retained by the company.
No agent, broker, employee or representative of Mini World Australia is authorized to alter, modify or waive requirements stated in the conditions of transportation or service.
